Description
In module 2, we turn to the client journey under the Public Access model. This is a highly complex area, and in the absence of an instructing solicitor places additional responsibilities on counsel - both in terms of client care as well as marketing themselves and due diligence. Our focus will be on the key rules and requirements prior to being formally instructed and the signing of the Client Care letter.

As a self-employed Public Access barrister you will need a clear strategy to:

Attract clients in a market dominated by traditional legal providers;

Identify and understand the Public Access client’s needs;

Establish clear fee expectations;

Handle vulnerable clients with complex needs; and

Manage the increased administrative burdens in the absence of a professional client.

In the lessons to follow, you will be equipped with the skills to effectively manage these crucial elements of initial client contact.

By the end of this module, you will:

Have an awareness of the key factors in attracting Public Access work and increasing the visibility of your practice.

Understand the importance of and principles of effective communication.

Know how to assess client suitability for a Public Access setting.

Be aware of the potential involvement of intermediaries and your responsibilities in this context.

Understand the additional steps needed when working with vulnerable clients in a Public Access setting.

Know how to effectively set the scope of work to be carried out.

Understand your obligations regarding marking and communication of fees.
